Cler appeal dismissed

The Appeals Body, Mr. J.R. Craigie (in the Chair), Mr. Charles Cunningham and Mr. Derek Pugh, met in the Turf Club Offices, The Curragh, Co. Kildare, at 10.00 a.m. on Thursday 24th July, 2008, to consider an appeal lodged by Mr. Willie Mullins against the decision of the Acting Stewards at Killarney on 17th July, 2008, when following the running of the Dawn Milk Run Handicap Hurdle Cler, trained by Mr. Mullins and ridden by Ruby Walsh, was disqualified and placed second following a Stewards Enquiry, having dead heated for first place with Grantsville, ridden by Paul Townend. The Stewards were of the opinion that Cler had caused interference to Grantsville and as a consequence improved his ultimate placing in the race.

Evidence was heard from Ruby Walsh, rider of Cler, Paul Townend, rider of Grantsville, Willie Mullins, trainer of Cler, and Tom McCourt, trainer of Grantsville. A film of the race was also viewed.

Having considered the evidence the Appeals body dismissed the Appeal.

Mr. Mullins was represented by Mr. Andrew R. Coonan, Coonan Cawley Solicitors, Naas, Co. Kildare and the case was presented to the Committee by Mr. Denis Egan, Turf Club Chief Executive.
