Melbourne Cup runner-up keeps place Luca Cumani's Bauer has held on to his second place in the Melbourne Cup following an inquiry. Cumani's Geelong Cup winner was found in breach of the rules after he underwent ultrasound therapy on the Thursday before the race. The treatment is legal in England except on raceday so Cumani was unaware he was breaking the rules. The trainer had been advised by a vet appointed by Racing Victoria Limited and their chief steward Terry Bailey said that factor meant Cumani could not be held culpable. "In these circumstances a trainer was reasonable to assume that a vet assigned by RVL would have been across the rules," said Bailey. He also confirmed that stewards only became aware of the treatment given to Bauer after receiving an itemised invoice from vets employed by RVL at the Sandown quarantine centre.
